Mineralissima supplies consumers in the Netherlands and beyond. These terms and conditions apply to the items offered in the Mineralissima online shop and by placing an order on our online shop or via email, the following general terms and conditions are accepted and agreed upon:
All prices in this webshop are in Euros, including VAT and excluding postage and packaging costs. VAT does not apply to orders outside the EU and will be deducted from the total price. Prices are subject to change. In case of price increases, you will be informed and have the right to cancel the order. If a product is out of stock, the corresponding prepaid amount will be credited.
Mineralissima accepts payments via Paypal, credit cards (Visa, Mastercard & American Express), IDEAL, advance bank payments, and -on request- cash on delivery payments. (The cost for this payment and shipping method is € 15.00). All credit card payments are subject to authorization by your credit card company, and Mineralissima cannot be held responsible for any delay or failure to deliver products due to payment refusal by your credit card company. Bank payments to our account must be transferred to ING in Hoofddorp, account number NL96INGB0003677793, mentioning the order number.
Ordered products are delivered from stock and will be sent by PostNL within 5 working days as soon as payment is received. If Mineralissima cannot deliver within thirty days after the conclusion of an agreement, a consumer is entitled to terminate the agreement in writing. Mineralissima will then refund the purchase amount paid by the consumer within fourteen days. Delivery of the ordered items is basically made on the paved road in front of the first door on the ground floor, unless explicitly agreed otherwise. Shipping costs depend on the weight of the order.
After the customer has received the product ordered by him/her, the customer has the option to dissolve the underlying agreement with Mineralissima within 14 working days after receipt of this product, provided the seal has not been broken. The customer does not have to give a reason for this.
5.1. If the customer wishes to dissolve the agreement within this period, the customer must notify customerservice (at) mineralissima.com in writing. After registering the return, the customer has another 14 days to return the product to the web store. If you make use of your right of withdrawal, the product will be returned to the entrepreneur with all delivered accessories and – if reasonably possible – in the original condition and packaging. If the product is damaged or the packaging is more damaged than necessary to sell the product, we may charge you for this depreciation of the product. So handle the product with care and ensure that it is well packaged when returned. The customer must bear the costs and risks of shipping themselves.
We have tried to approximate the natural colors of the makeup as accurately as possible. However, please note that all monitors and printers may have different color settings and that color deviations may occur. In case of doubt, we recommend ordering samples first. Under no circumstances will Mineralissima accept returns of products if color deviations occur, except as provided in article 5.
The products supplied by Mineralissima remain the property of Mineralissima until the customer has properly fulfilled all obligations under the agreement concluded with Mineralissima.
In the event that Mineralissima invokes the retention of title, the agreement shall be considered terminated, without prejudice to Mineralissima's right to claim compensation for damages, lost profits, and interest.
The products supplied by Mineralissima remain the property of Mineralissima until the customer has properly fulfilled all obligations under the agreement concluded with Mineralissima.
In the event that Mineralissima invokes the retention of title, the agreement shall be considered terminated, without prejudice to Mineralissima's right to claim compensation for damages, lost profits, and interest.
If Mineralissima is held liable, any liability is limited to a maximum of the invoice value of the agreement, or at least to that part of the agreement to which the liability relates.
Mineralissima is only liable for direct damage. Direct damage shall be understood exclusively as:
Mineralissima excludes all liability for indirect damage suffered from the use of the Products supplied by Mineralissima.
The products supplied by Mineralissima have been extensively tested, however Mineralissima cannot accept liability for situations in which users of the products may exhibit an allergic reaction to the products.
It can always happen that something does not go exactly as planned. We recommend that you first report complaints to us by emailing customerservice (@) mineralissima.com. From February 15, 2016, it is also possible for consumers in the EU to submit complaints via the ODR platform of the European Commission. This ODR platform can be found at http://ec.europa.eu/odr. If your complaint is not yet being handled elsewhere, you are free to file your complaint via the European Union platform.
Dutch law exclusively applies to all rights, obligations, offers, orders, and agreements to which these terms and conditions apply, as well as to these terms and conditions themselves.
The customer and Mineralissima will attempt to resolve any disputes through mutual consultation. Any disputes shall, unless mandatory law rules oppose this, be submitted exclusively to the competent court in the district where Mineralissima is statutorily established.
